Personally I think they should just increase the prices and let people decide whether to eat there or not. Why should we be in charge of deciding if their staff deserve benefits? I donโt get it.
I think the answer to your question is: possibly usually? Restaurants seems to handle them in a variety of ways, so I'm not sure about the laws!
In Canada, charges of these types are still very rare.
I did notice them in Syracuse, NY.
I decline them and give my server a generous cash tip.
